Checking an Italian company: a guide for UK businesses after Brexit
Updated to
In short: to check an Italian company from the UK, search Italy's own business register, Registro Imprese, because Companies House only covers the UK register. Since 1 January 2021 UK courts no longer apply the Brussels Ia Regulation, so the contract and its jurisdiction clause matter more. Veryfy reports on Italian companies from Italian official sources, from €19, in Italian, with a free anti-scam check.
What changed for UK businesses after Brexit
- According to GOV.UK, SI 2019/479 took effect at 11pm on 31 December 2020 and revoked the Brussels Ia Regulation as it applied in the UK. For new cases, jurisdiction in the courts of England and Wales comes from domestic law. (GOV.UK guidance)
- The 2005 Hague Convention on Choice of Court Agreements still applies to the UK. The HCCH status table lists entry into force on 1 October 2015 for both the European Union and the United Kingdom; Italy is bound through the EU. (HCCH status table)
- Italy keeps its own rules on recognising foreign judgments: art. 64 of Law 218/1995 lists seven conditions. (Normattiva)
Where to look first
Companies House makes the data it holds on UK companies available free of charge, and its name search excludes UK establishments of overseas companies (GOV.UK). For an Italian company the official source is Registro Imprese, the portal of the Italian Chambers of Commerce run by InfoCamere. It offers a free company search and documents such as the visura camerale, annual financial statements (bilancio d'esercizio) and protest records, and lists an English-language visura (Registro Imprese, the Italian business register portal (InfoCamere)).
