2027 budget law and flat tax: the stages, the dates and where to read the official texts
Updated to
In short: as of 23 October 2026 the 2027 budget law has not been approved: the government adopted only the draft budget policy document on 13 October, and the bill has not yet passed the Council of Ministers, expected at the end of October according to the press. Parliament must approve it by 31 December for the new rules to apply from 1 January 2027.
Where does the 2027 budget law stand?
As of 23/10/2026 only the first stage is complete: the draft budget policy document, approved by the Council of Ministers on 13 October and sent to Brussels and to the Chambers. The draft budget law, that is, the text with the tax measures, was not approved at the Council of Ministers meetings of 20 and 22 October. Without that text, no measure for 2027 has an official form yet.

When does the draft budget bill reach the Council of Ministers?
There is no official date. According to the press, examination of the bill is expected at the end of October 2026; in the Council of Ministers press releases no. 193 of 20 October and no. 194 of 22 October the text does not appear. The public accounting law set 20 October as the deadline for submitting it to the Chambers, and that date passed without filing.
The deadline is written in art. 7, para. 2, letter d) of Law 196 of 2009: "the draft State budget law, to be submitted to the Chambers by 20 October each year". The draft budget policy document, instead, must be submitted to the European Commission and the Eurogroup by 15 October and transmitted to the Chambers by the same deadline (art. 9, para. 1-bis, of the same law, which refers to art. 6 of Regulation (EU) No 473/2013).
Why an announcement is not law: announcement, bill, amendments
An announcement at a press conference or a leak is a statement of intent; the bill approved by the Council of Ministers is a written proposal from the government; the law is the text voted by the Chamber and the Senate and published in the Official Gazette. Only the last one has effects, and between one stage and the next the contents can change.
- Announcement or leak. This is the stage at which the €100,000 flat-rate regime stands today: Sky TG24 (13/10/2026) and Alanews (20/10/2026) report it, but the draft budget policy document does not mention it.
- Bill. The text the government submits to the Chambers: for the first time it shows how the rule would be written, with thresholds, effective dates and any exceptions.
- Amendments. During parliamentary examination, deputies, senators and the government can modify the text: a measure may be added, removed or change its figure until the final vote.
- Published law. Only the text in the Official Gazette counts for your tax return. Until then, for the flat-rate regime the rules of art. 1, paras. 54-89, of Law 190 of 2014 apply, with the threshold at €85,000.
Where can the official texts of the budget law be read?
Each stage has its own website: the government publishes the Council of Ministers press releases, the Ministry of Economy and Finance (MEF) the public finance documents, the Chamber and the Senate the bills with their amendments, the Official Gazette the approved law, and Normattiva the consolidated text in force. Be wary of summaries without links: an article that does not cite the act is not a source.

What happens if the law is not approved by 31 December?
A provisional budget (esercizio provvisorio) is needed, which the Constitution allows only under two conditions: a law granting it and a limited duration. Art. 81 establishes that each year the Chambers approve the budget presented by the government by law, and that "the provisional budget may not be granted except by law and for periods not exceeding four months in total".
For those waiting for the flat-rate regime at €100,000 one practical point matters: until a law changes art. 1 of Law 190 of 2014, the threshold remains the one in force, €85,000.
Parliamentary proposals on the flat-rate regime
Alongside the budget law there are bills of parliamentary initiative that amend the flat-rate regime. One is in the Senate: bill S.2033, presented on 14 September 2026 and assigned to committee on 30 September, not yet examined. A parliamentary bill assigned to committee is not law and has no timetable: it can remain stalled until the end of the legislature.
- S.2033, "Amendment to Article 1 of Law No. 190 of 23 December 2014, concerning the conditions of access to the flat-rate regime", on the initiative of Senator Stefania Craxi and others. Presented on 14/09/2026; from 30/09/2026 "assigned (examination not yet started)" to the 6th Standing Committee (Finance and Treasury) in the redigente procedure (the committee drafts the text). Record: senato.it, bill S.2033.
- C.359, "Amendments to Article 1 of Law No. 190 of 23 December 2014, concerning the flat-rate regime for individuals carrying on business, arts or professions", on the initiative of Deputy Riccardo Molinari and others, presented to the Chamber on 14/10/2022 and assigned, without examination, from 22/12/2022.
We will not summarise the content of these texts here: we will describe it only after reading the official text. The €100,000 threshold reported in the press is tied to the budget law, not to these bills.
When will we know whether the flat-rate regime rises to €100,000?
With certainty, only with the 2027 budget law published in the Official Gazette, expected by 31 December 2026. A first concrete signal will be the bill approved by the Council of Ministers: if the €100,000 threshold is there, it will be read for the first time in an official text, still amendable.
Meanwhile you can work out what it is worth to you. A professional who takes €90,000 in the separate management scheme today remains in the flat-rate regime until the end of the year, with a deduction of €26,085.97 between contributions and tax; from the following year, in the ordinary regime, with the same estimated costs, they would pay €32,817.65, surcharges excluded. With the €100,000 threshold the difference, €6,731.68 a year, would not be paid: redo the calculation with your own numbers.
What would really change, band by band, is in the hub flat tax 2027 for sole traders. For those already above €85,000: exceeding €85,000 in the flat-rate regime: what happens. For the VAT issue: flat-rate regime at €100,000 but VAT from €85,000.
