Fraudulent bankruptcy and «new company»: entire business assets of a company seized in Taranto (GdF, 21 October 2026)

Updated to

In short: on 21 October 2026 the Guardia di Finanza of Taranto executed an order from the GIP, at the request of the Procura della Repubblica (public prosecutor's office), ordering the preventive seizure of the entire business of a Taranto-based wholesale food company, and of assets worth over 1.2 million euros. The alleged scheme is that the assets of a business declared bankrupt in 2023 were diverted to a «new company» in the same sector, de facto attributable to the same persons. For those assessing customers and suppliers, this is a reminder: after a bankruptcy, a new company with the same business and the same contacts deserves an extra check.

What happened?

According to the press release, on 21 October the officers of the Nucleo di Polizia Economico-Finanziaria (Economic and Financial Police Unit) of the Guardia di Finanza of Taranto executed an order from the Giudice per le indagini preliminari (GIP, judge for preliminary investigations) of the Tribunale di Taranto, at the request of the Procura della Repubblica, which imposes the precautionary measure of preventive seizure of the business of a Taranto-based company operating in the wholesale trade of food products, and of assets worth over 1.2 million euros. The shares of the «new company» and the assets held by the suspects were also seized. The seized company has been entrusted to a judicial administrator (amministratore giudiziario) appointed by the Tribunale di Taranto.

Seven persons are under investigation in total: partners, directors and employees, both de facto and de jure, of the companies involved. The alleged offences are fraudulent bankruptcy (bancarotta fraudolenta), self-laundering (autoriciclaggio), concealment of accounting records and fraudulent evasion of tax payments (sottrazione fraudolenta al pagamento di imposte). The press release adds that the Procura had also requested personal precautionary measures, which the GIP did not grant due to the lack of current need for precautionary measures (mancanza di attualità delle esigenze cautelari).

What scheme does the investigation describe, according to the charges?

The investigation started from the bankruptcy, declared in 2023, of a Taranto company burdened by significant tax debts owed to the Erario (Italian state tax authority). The checks reportedly provided circumstantial evidence to believe that the suspects fraudulently diverted the assets of the failed business to a new company, based in Taranto, operating in the same trade sector and de facto attributable to the same persons.

ElementWhat the press release indicates
Starting companyDeclared bankrupt by ruling of 2023, with significant tax debts owed to the Erario
New companyBased in Taranto, same trade sector, de facto attributable to the same persons
Alleged effect on assetsDiversion of the failed company's assets in favour of the «new company»
MeasurePreventive seizure of the entire business, of the shares and of the suspects' assets, for over 1.2 million euros

The press release specifies that the case is at the preliminary investigation stage, that the evidence gathered and the precautionary measure are provisional in nature, that the order rests on a finding of mere probability (serious indications of guilt, gravi indizi di colpevolezza) and does not establish any liability: under the presumption of innocence, liability will be established only by a final conviction.

Why does it matter for those assessing customers and suppliers?

The press release says nothing about the commercial relationships of the seized company, and we draw no conclusions from it. A seizure of the entire business with entrustment to a judicial administrator, however, is an event that can change who runs the company and under what conditions it operates. These are signals to be assessed together, never as proof on their own:
