Masonry and construction contractors in Italy: compliance checks on subcontractors and suppliers
Updated to
In short: a masonry or construction contractor working in Italy with Italian subcontractors and material suppliers should check four things before a multi-year framework: the DURC (contribution compliance, valid 120 days), the prefecture white list for at-risk supplies such as aggregates, concrete and worked iron (valid twelve months), the company's financial solidity, and the joint liability you take on for the subcontractor's workers. A Veryfy Verification (€19) covers the financial side in one report.

DURC: contribution compliance
The DURC (Documento unico di regolarità contributiva) certifies that a company is regular with its payments and obligations towards INPS, the social security institute, and INAIL, the workplace injury insurer; for companies classified in construction, or applying the construction collective agreement, the check also covers the Casse Edili, the construction workers' funds. According to INAIL, the Durc online can be checked by anyone with an interest, against the tax code of the company, and a regular result is valid for 120 days from the query (INAIL: Durc online).
Over a multi-year framework, 120 days means roughly three checks a year. Tie them to the payment cycle: ask for a current DURC before each progress payment rather than once at signing. A regular DURC says contributions are paid; it says nothing about wages actually paid or about the company's debts to suppliers and banks. Our guide Valid DURC but the subcontractor does not pay wages explains the gap.
The prefecture white list for at-risk supplies
Italian law identifies business activities most exposed to mafia infiltration and lets companies working in them register on a list kept by the prefecture of the province where they have their registered office (Law 190/2012, art. 1, paragraphs 52 to 57, as amended by Decree-Law 23/2020). Several of them are the daily supplies of a masonry job:
- extraction, supply and transport of soil and aggregates;
- production, supply and transport of concrete and bitumen;
- supply of worked iron;
- plant hire without operator, and with operator;
- road haulage for third parties;
- site security.
Registration is voluntary, valid for twelve months subject to periodic checks, and for registered companies it replaces the antimafia information that public bodies and contracting authorities would otherwise request (Prefettura: white list information sheet). On public works it is the practical gateway; on private works it is still a strong signal. Check the list on the website of the competent prefecture, and check again at each yearly renewal of your framework.
Joint liability for the subcontractor's workers
Art. 29(2) of Legislative Decree 276/2003 states that, in a contract for works or services, the client that is an entrepreneur or employer is jointly liable with the contractor, and with each subcontractor, within two years of the end of the contract, for wages including severance quotas, social security contributions and insurance premiums due for the contract period; civil penalties stay with the party in default. The Constitutional Court confirmed in judgment no. 254 of 2017 that the rule also applies to sub-supply (Ispettorato Nazionale del Lavoro, circular no. 6/2018).
On a multi-year framework, the two years run from the end of each contract, so the exposure follows you well after the last day on site. That is why a weak subcontractor is a direct cost risk, not only a delivery risk. See Subcontracts, construction sites and joint liability.
Financial checks before the framework
| Check | Source | Validity | In a multi-year framework |
|---|---|---|---|
| DURC | Durc online (INPS, INAIL, Casse Edili) | 120 days | Before each progress payment |
| White list (at-risk supplies) | Competent prefecture | 12 months | At each yearly renewal |
| Register, accounts, protests, proceedings | Registro Imprese, Registro Protesti | Until the next event | At signing, then yearly and on events |
| Owners and directors | Registro Imprese | Until the next change | Continuous, with alerts |

Where Veryfy fits
A Veryfy Verification (€19) puts the register data, beneficial owner, shareholders and directors, protests and insolvency signals and an estimated operating credit line into one report from Italian official sources, so you know how much work and how many advances you can reasonably entrust to that subcontractor. For a key partner on a multi-year framework, the Investigation (€99) adds risk algorithms developed by experienced risk managers and includes the Sentinella free for 12 months, which emails you when accounts, directors, shareholders, registered office or PEC change. Reports are in Italian; How to read an Italian company report is the glossary.
Frequently asked questions
What is a DURC and how long is it valid?
The DURC is the certificate of contribution compliance: it confirms that a company is up to date with payments to INPS and INAIL and, for construction companies, to the Casse Edili. A regular DURC is valid for 120 days from the date of the query.
Which construction suppliers can join the prefecture white list?
Among others: extraction, supply and transport of soil and aggregates; production, supply and transport of concrete and bitumen; supply of worked iron; plant hire with or without operator; road haulage for third parties; and site security. Registration is voluntary and valid for twelve months.
Can I be liable for my Italian subcontractor's unpaid wages?
Under art. 29(2) of Legislative Decree 276/2003, the client that is an entrepreneur or employer is jointly liable with the contractor and each subcontractor, for two years after the contract ends, for wages, severance quotas, social security contributions and insurance premiums due for the contract period. Ask an Italian lawyer how it applies to your structure.
